Lifetime Ban: Elizabeth Holmes Barred from Federal Health Programs for 90 Years

Federal regulators declared on Friday that Elizabeth Holmes, the convicted fraudster and founder of the now-defunct Theranos blood testing company, will face a 90-year ban from participating in federal health programs—an effective lifetime prohibition.

The Office of Inspector General (OIG) for the Department of Health and Human Services (HHS) cited Holmes's 2022 conviction for fraud and conspiracy to commit wire fraud as the primary reason for this lengthy ban.

Holmes, sentenced to approximately 11 years in prison starting May 2023 for deceiving investors about her blood-testing technology, had her sentence reduced by two years in July.

The OIG explained in a statement, "The statutory minimum for an exclusion based on convictions like Holmes’s is five years. When certain aggravating factors are present, a longer period of exclusion is justified." The factors considered included the duration of the fraudulent acts, incarceration, and the ordered restitution amount.

Exclusion from federal health care programs implies that Holmes is ineligible for benefits from programs like Medicare or Medicaid. Moreover, she cannot work for an entity receiving federal health care funding, except in limited circumstances.

Ramesh “Sunny” Balwani, Theranos COO and Holmes's business associate, had already received a similar 90-year exclusion from federal programs.

HHS Inspector General Christi A. Grimm emphasized the importance of accurate diagnostic testing technology for public health. She stated, “False statements related to the reliability of these medical products can endanger the health of patients and sow distrust in our health care system.”
